These Terms of Service (“Terms”) govern your use of the website boostpouchco.com and the products and services provided by Boost Pouches Inc. (“Company,” “we,” “us,” or “our”). By accessing our website or placing an order, you agree to these Terms. If you do not agree, please do not use this website or purchase our products.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use this website or purchase our products. By placing an order, you confirm that you meet this requirement and can enter into a binding agreement.

2. VIP Membership and Subscription Billing

Every purchase includes VIP Membership with a 28-day free trial, starting on the purchase date. Then $39.99 USD every 28 days until cancelled. Cancel anytime before your next billing date and you will not be charged again.

Every purchase includes VIP Membership. The free-trial, recurring billing, and cancellation terms are shown before checkout.

Billing terms:

  • Membership fee: $39.99 USD every 28 days until cancelled (plus applicable taxes)
  • Billing cycle: every 28 days (13 charges per year, totaling $519.87 USD per year before taxes)
  • Your 28-day free trial starts on the purchase date. Your first membership charge occurs 28 days after purchase, then $39.99 USD every 28 days until cancelled
  • Charges are billed to the payment method used for your original order
  • Your membership renews automatically every 28 days until you cancel
  • There is no minimum commitment. Cancel anytime before your next billing date and you will not be charged again.

Price changes: If the membership fee changes, we will notify you by email at least 30 days before the new price applies. You may cancel before the change takes effect.

3. VIP Membership Benefits

VIP Members receive:

  • Savings of 50% or more on future orders
  • Free shipping on member orders
  • Priority shipping on member orders
  • Priority customer support

We may update or improve benefits over time. If we make a material change that reduces your benefits, we will notify you by email before it takes effect, and you may cancel at any time.

4. How to Cancel

You may cancel your VIP Membership at any time, for any reason, by contacting us:

Cancel anytime before your next billing date and you will not be charged again. We will email you a confirmation once your cancellation is processed. Your benefits remain active until the end of your current paid billing cycle.

Refunds on membership fees: If you contact us within 7 days of a membership charge and have not used any member benefits during that billing cycle, we will refund that charge. Otherwise, membership charges already processed are non-refundable, except where required by law.

5. Order Changes and Cancellations

You may modify or cancel an order before it ships by contacting us. Once an order has shipped, it can no longer be canceled, but it may be eligible for return under Section 6.

6. Return Policy

  • Returns are accepted within 30 days of delivery
  • Products must be unopened and unused (opened cans are not eligible)
  • You are responsible for return shipping costs
  • An $8 return processing fee is deducted from your refund
  • Refunds are issued to your original payment method after the returned items are received and inspected
  • We do not offer store credit in place of refunds

7. Shipping and Delivery

  • Orders are processed within 1 to 3 business days
  • Delivery times vary by location and carrier
  • If a package is lost in transit, we will reship it at no additional cost
  • We are not responsible for delays or failed deliveries caused by incorrect shipping information provided by the customer, or by carrier delays outside our control

8. Product Use and Safety

Boost Pouches are intended for responsible adult use only. Do not use more than 4 pouches per day.

Do not use if you are:

  • Pregnant or breastfeeding
  • Sensitive to caffeine or other stimulants
  • Prone to anxiety, or have a heart condition or high blood pressure
  • Taking medication or under medical treatment, unless approved by your physician
  • Under 18 or under the age of majority in your jurisdiction

Consult a healthcare professional before use if you have any medical condition. Stop use and contact a healthcare professional if you experience any adverse reaction. Keep out of reach of children and pets.

9. No Medical Claims

These statements have not been evaluated by the Food and Drug Administration or Health Canada. Our products are not intended to diagnose, treat, cure, or prevent any disease. Information on this website is for general informational purposes only and is not medical advice.

10. Disclaimer of Warranties

Except as expressly stated in these Terms, our website and products are provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law.

11. Limitation of Liability

To the fullest extent permitted by law, the Company will not be liable for any indirect, incidental, or consequential damages, including loss of profits, revenue, or data, or for reactions resulting from misuse of our products or use contrary to Section 8. Our total liability for any claim relating to a purchase will not exceed the amount you paid for that purchase. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Payment Authorization

By submitting payment, you authorize the Company to charge your payment method for your order and for recurring VIP Membership fees as described in Section 2. Cancel anytime before your next billing date and you will not be charged again.

If you have any concern about a charge, or don’t recognize a charge from us on your statement, please contact us first. We respond within 24 hours and can usually resolve billing issues faster than a dispute through your bank.

13. Intellectual Property

All website content, branding, images, and materials are the property of the Company and may not be copied or used without our written permission.

14. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date above shows when they were last changed. Material changes affecting VIP Membership billing will be sent to members by email in advance as described in Section 2. Changes do not apply retroactively to orders already placed.

15. Governing Law and Severability

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without limiting any consumer protection rights you have under the laws of where you live. If any part of these Terms is found to be unenforceable, the remaining parts will stay in effect.
