Boost Pouches Inc. (“Boost Pouches,” “we,” “us,” or “our”) is a company registered in British Columbia, Canada. We are committed to protecting your privacy. This Privacy Policy (“Policy”) explains how we collect, use, share, and protect your personal information when you visit boostpouchco.com, place an order, enroll in our VIP Membership, or otherwise interact with us (collectively, the “Services”).

1. Information We Collect

1.1 Information you provide to us

  • Order and account information: name, email address, phone number, billing address, and shipping address
  • Payment information: card details entered at checkout. Card details are processed and stored by our payment processors in tokenized form. We do not store your full card number on our own systems.
  • Age information: date of birth or confirmation of age, where needed to confirm you are 18 or older
  • Communications: messages you send us by email, phone, or chat, and your responses to surveys
  • Reviews and content: product reviews or other content you choose to submit
  • Marketing sign-ups: your email address or phone number if you subscribe to our emails or text messages

1.2 Information collected automatically

  • Usage data: pages viewed, time on site, clicks, and the website or ad that referred you
  • Device data: IP address, browser type, operating system, and device identifiers
  • Approximate location: general location (such as city or region) based on your IP address
  • Cookies and similar technologies: see Section 6

1.3 Information from third parties

  • Advertising and analytics partners: such as Meta and Google, which may share information about how you interacted with our ads
  • Payment and fraud prevention providers: information used to verify transactions and prevent fraud

2. How We Use Your Information

We use your information to:

  • Process, ship, and support your orders
  • Manage your VIP Membership, including processing recurring charges you agreed to and handling cancellations and refunds
  • Verify your age where required
  • Detect and prevent fraud and unauthorized transactions
  • Respond to your questions and provide customer support
  • Send order confirmations, shipping updates, and membership-related notices
  • Send marketing emails or text messages, if you have opted in
  • Show you relevant ads on other websites and social media
  • Analyze and improve our website, products, and services
  • Comply with legal obligations, such as tax and accounting requirements

3. How We Share Your Information

We share personal information only as described below:

  • Service providers: companies that help us run our business, including payment processors and payment platforms, our ecommerce platform, fulfillment and shipping partners, customer support tools, and email or SMS providers. They may use your information only to provide services to us.
  • Advertising and analytics partners: such as Meta and Google, which may receive information through cookies and pixels on our website (see Section 6)
  • Legal and safety reasons: when required by law, or to protect our rights, our customers, or others, including to respond to payment disputes
  • Business transfers: if our business is sold, merged, or restructured
  • With your consent: in any other case where you have agreed to the sharing

We do not sell your personal information for money. Some jurisdictions consider sharing data with advertising partners through cookies and pixels to be a “sale” or “sharing” of personal information. See Sections 4 and 11 to opt out.

4. Your Rights and Choices

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you
  • Correct inaccurate information
  • Request deletion of your information
  • Withdraw your consent
  • Opt out of marketing
  • Opt out of targeted advertising or the “sale” or “sharing” of your information
  • Request a copy of your information in a portable format

To make a request, email hello@boostpouches.com. We may need to verify your identity before responding. We respond within the time required by applicable law, generally within 30 days, or 45 days for California residents.

Opting out of marketing:

  • Email: click “unsubscribe” in any marketing email
  • Text messages: reply STOP to any marketing text
  • Any time: contact hello@boostpouches.com

Opting out of marketing does not stop order, shipping, or VIP Membership notices.

Do Not Track: Our website does not respond to browser “Do Not Track” signals. You can control tracking through your cookie and browser settings (see Section 6).

5. Text Messages

If you opt in to text messages, you agree to receive recurring automated marketing messages from Boost Pouches at the number provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. We do not share your mobile number or text messaging consent with third parties for their own marketing.

6. Cookies and Tracking Technologies

We and our partners use cookies, pixels, and similar technologies, including:

  • Essential cookies: needed for the website and checkout to work
  • Functional cookies: remember your cart and preferences
  • Analytics cookies: help us understand how visitors use our website
  • Advertising cookies and pixels: such as the Meta Pixel and Google tags, used to measure ads and show you relevant ads

You can manage cookies through your browser settings and, where available, our cookie banner. You can also opt out of interest-based ads through the Digital Advertising Alliance (optout.aboutads.info) or the Network Advertising Initiative (optout.networkadvertising.org). Disabling some cookies may affect how our website works.

7. Data Security

We use reasonable administrative, technical, and physical safeguards to protect your information, including encryption of payment data, access controls, and working with service providers that maintain appropriate security. No system is completely secure, so we cannot guarantee absolute security. If you believe your information has been compromised, contact us at hello@boostpouches.com.

8. Where Your Information Is Stored

We are based in Canada, and many of our service providers are located in the United States or other countries. Your information may be stored and processed outside your province, state, or country, where it may be accessible to authorities under local laws. By using our Services, you acknowledge this transfer. Where required, we use appropriate safeguards for international transfers.

9. Data Retention

We keep personal information only as long as needed for the purposes described in this Policy, including:

  • Order, payment, and membership records: as long as required by tax and accounting laws (generally up to 7 years)
  • Marketing information: until you unsubscribe or ask us to delete it
  • Other information: until it is no longer needed for business or legal purposes

When information is no longer needed, we securely delete or anonymize it.

10. Age Restrictions

Our products and Services are intended only for adults 18 or older. We do not knowingly collect personal information from anyone under 18. If we learn that we have, we will delete it. If you believe a minor has provided us with information, contact hello@boostpouches.com.

11. California Privacy Rights

If you are a California resident, you have the right to:

  • Know what personal information we collect, use, and disclose
  • Request access to or deletion of your personal information
  • Correct inaccurate personal information
  • Opt out of the “sale” or “sharing” of your personal information, including for targeted advertising
  • Not be discriminated against for exercising these rights

To exercise these rights, email hello@boostpouches.com with the subject line “California Privacy Request.” You may also use an authorized agent to make a request on your behalf.

Shine the Light: We do not share personal information with third parties for their own direct marketing purposes.

12. Canadian Privacy Rights

We handle personal information in accordance with applicable Canadian privacy laws, including British Columbia’s Personal Information Protection Act and the federal Personal Information Protection and Electronic Documents Act. You may request access to or correction of your personal information, or withdraw your consent, by contacting our Privacy Officer at hello@boostpouches.com. If you are not satisfied with our response, you may contact the Office of the Information and Privacy Commissioner for British Columbia or the Office of the Privacy Commissioner of Canada.

13. Rights for Users in the EEA and UK

If you are in the European Economic Area or the United Kingdom, we process your information based on:

  • Contract: to fulfill your orders and membership
  • Consent: for marketing and non-essential cookies
  • Legitimate interests: such as fraud prevention and improving our Services
  • Legal obligations: such as tax record keeping

You may access, correct, delete, restrict, or object to the processing of your information, and request a portable copy. You also have the right to file a complaint with your local data protection authority, or the Information Commissioner’s Office in the UK.

We may update this Policy from time to time. We will update the “Last Updated” date above, and for significant changes, we may also notify you by email or a notice on our website. Changes apply from the date they are posted.
